WARRANTY. Zoologix provides diagnostic testing services in accordance with information provided by the Client on the Zoologix Order Form. Zoologix warrants that the services provided shall be performed in accordance with information provided by the Client and standard operating procedures for the services requested. Any warranty claim shall be made in writing to Zoologix no later than ninety (90) days after the date that the Zoologix Results Report is delivered to the Client. Zoologix may choose, at its option, to re-perform the service or return the fee paid for the service in question. This shall be the sole warranty of Zoologix. Under no circumstances shall Zoologix be liable to the Client, or to any third party claiming by or through the Client, as a result of Zoologix's failure to perform the services, for any consequential, special, or other damages, including damage arising from acts of negligence on the part of Zoologix, and the warranty set forth in this paragraph is in lieu of any and all other warranties relating to the services to be performed, express or implied, including, without limitation, any implied warranties of merchantability or fitness for a particular purpose and non-infringement of a patent, trademark or other intellectual property right. In purchasing services from Zoologix, the Client expressly releases and discharges Zoologix from all such causes of action or damages.

FORCE MAJEURE. Zoologix shall not be liable for any delay in or impairment of performance resulting in whole or in part from Acts of God, labor disruptions, shortages, inability to procure supplies, severe weather conditions, terrorism or any other circumstances or cause beyond the control of Zoologix in the conduct of its business.

ORDER CANCELLATION. Any cancellation must be approved by Zoologix, and may be subject to partial charges.

PAYMENT TERMS. Unless other arrangements are approved in writing by Zoologix, payment must be made at time of order. Visa and MasterCard are accepted. Assay results will be returned after credit card payment is approved and posted to our financial institution, or when check payment clears and is posted to our financial institution. Checks drawn on insufficient funds are subject to a $25 service charge. 1% of the balance outstanding will be charged per month to overdue accounts.

PRICING AND BILLING ERRORS. Zoologix retains the right to correct clerical invoice calculation errors. All claims by buyers for pricing errors must be made to Zoologix within 10 days after customer's receipt of invoice.
